How long does a Texas landlord have to return a security deposit?

Texas Property Code §92.103 generally requires a refund on or before the 30th day after surrender of the premises. Section 92.107 qualifies the obligation: the landlord is not required to refund or provide the written damage description until the tenant supplies a written forwarding address. Failure to give an address does not forfeit the tenant's right to a refund.

Build your decision checklist

Use this checklist to organize the facts and documents for your review.

  • Record surrender of the premises and receipt of the tenant's written forwarding address.
  • Check the lease, permitted deductions and §92.104's itemization requirements and exceptions.
  • Keep normal wear and tear out of deposit deductions and retain supporting records.

Check applicability and exceptions

This concerns covered residential security deposits, not application fees or all commercial arrangements. Review the controlling statutory text and any circumstances affecting surrender or notice.

  • Confirm the property address, housing type, lease and any assistance program.
  • Check applicable city and county requirements and any recent amendments or court decisions.
  • Get qualified local advice for a disputed deposit or uncertain deadline.

Keep the rental record together

Acrelio helps organize lease, deposit and move-out records. Pro electronic lease signatures include a completed audit page. Recordkeeping features support your process; they do not guarantee compliance or replace legal review.

Important context: This is an educational summary of selected sources, not legal advice, attorney review or a complete state rulebook. The official authority controls. Source versions, effective dates and the date Acrelio checked a source are distinct. No legal notice is automatically generated or sent.
