Florida deposit returns, in plain English.

Understand the statewide starting point, the facts that make it apply, and the official source behind it. Confirm current law and local requirements before acting.

How long does a Florida landlord have to return a security deposit?

For tenancies covered by §83.49, return the deposit within 15 days after the rental agreement terminates if you make no claim, with interest if required. If you intend to claim against it, the written claim notice is due within 30 days after termination. The 2026 text allows certified mail or email meeting §83.505; an ordinary email is not automatically sufficient.

Build your decision checklist

Use this checklist to organize the facts and documents for your review.

  • Confirm termination, vacancy, forwarding details and whether a claim will be made.
  • Use the required claim wording and permitted delivery method when retaining funds.
  • Check the tenant's 15-day objection window. If no timely objection is made, remit the balance within 30 days after the claim notice.

Check applicability and exceptions

Review §83.49(4) for excluded or specially regulated housing and (5) for early-vacancy notice exceptions. A disputed claim needs separate resolution; the claim deadline is not a blanket refund deadline.

  • Confirm the property address, housing type, lease and any assistance program.
  • Check applicable city and county requirements and any recent amendments or court decisions.
  • Get qualified local advice for a disputed deposit or uncertain deadline.

Read the official source

Keep the rental record together

Acrelio helps organize lease, deposit and move-out records. Pro electronic lease signatures include a completed audit page. Recordkeeping features support your process; they do not guarantee compliance or replace legal review.

Important context: This is an educational summary of selected sources, not legal advice, attorney review or a complete state rulebook. The official authority controls. Source versions, effective dates and the date Acrelio checked a source are distinct. No legal notice is automatically generated or sent.
